Intense Competition and IP Issues Among E-commerce Giants
US sellers, particularly those specializing in handmade and vintage items, are increasingly under pressure as they face competition from low-priced, low-quality imitations on platforms like Temu and Shein. These two Asian e-commerce giants are themselves struggling with fierce competition against each other, engaging in lawsuits over accusations of encouraging IP infringement and counterfeiting.
The race to the bottom in pricing is making it hard for US sellers to stand out, especially on platforms like Etsy, which now accommodates mass-produced items labeled as “designed by” handmade. This blurring of lines between genuine handmade products and factory-made goods complicates the market for shoppers committed to supporting local businesses.
Walmart’s New Fulfillment Services Rival Amazon’s Dominance
Walmart is expanding its logistics capabilities by opening its fulfillment services to third-party sellers across various platforms, including direct competitors like Amazon. This strategic move positions Walmart as a strong contender against Amazon’s Fulfillment by Amazon service, aiming to enhance the merchant and customer experience with comprehensive warehousing, delivery, and import services.
Starting September 10, Walmart’s initiative will also handle imports from Asia and offer competitive shipping rates, reflecting its broader strategy to integrate e-commerce with streamlined logistics. The expansion is expected to significantly boost Walmart’s revenue streams and market presence in the logistics sector.
UPS Applies Surge Fee to Packages from Asia
UPS is implementing a surge fee for packages shipped from Asia to the United States, affecting imports from ten countries with varying fees, highlighted by a $0.50 per-pound fee for shipments from China, Hong Kong, and Macau. This decision aims to manage the profitability challenges posed by the high volume of low-margin e-commerce shipments from companies like Temu and Shein, compared to more lucrative sectors like healthcare and small business deliveries.
The additional fees are part of UPS’s strategy to maintain high service quality and timely deliveries without compromise, set to begin on September 15, 2024. This change could impact Amazon sellers who rely on Asian markets for sourcing products, potentially increasing operational costs and affecting pricing strategies.
Amazon Faces Renewed Antitrust Suit After Appeals Court Decision
The D.C. Court of Appeals has revived an antitrust lawsuit against Amazon, which accuses the tech giant of using its market dominance to inflate prices artificially through restrictive contracts known as “minimum margin agreements.” These agreements prevented sellers on Amazon from offering lower prices on other platforms, which allegedly led to anticompetitive effects. The lawsuit, initiated by the D.C. Attorney General’s office, will now return to the D.C. Superior Court for further proceedings, focusing on Amazon’s pricing policies that may stifle market competition and innovation.
This decision has significant implications for Amazon sellers as it directly challenges the mechanisms Amazon uses to control pricing and maintain its market dominance. Sellers should be aware of potential changes in how they can price their products across platforms in response to this legal scrutiny.
E-Commerce Continues to Propel Retail Sales Amid Slow Growth
Despite a general slowdown in e-commerce growth, online shopping continues to play a crucial role in the overall expansion of retail sales, accounting for $17.4 billion of the $31.4 billion increase in retail spending this quarter. While total U.S. retail sales increased by 1.9%, sales from physical stores saw only a marginal rise of 1%, a figure that trails behind the inflation rate. This disparity highlights e-commerce’s significant contribution to retail, where it drove 53% of the growth over the past year, despite representing only 16% to 22% of total retail.
For Amazon sellers, this trend underscores the continuing shift towards online platforms, with e-commerce not only sustaining but driving retail growth in a sluggish market. The dynamics within the e-commerce sector show a competitive landscape where major players like Amazon and Walmart, along with emerging names like Shein and Temu, are significantly outperforming smaller platforms like eBay and Etsy.
BlackRock Initiates Auction of Amazon Aggregator SellerX
BlackRock Inc. is set to auction SellerX, a German startup and Amazon brand aggregator once valued at $1 billion, due to a defaulted loan. The auction is a direct response to the failure of SellerX to sustain its business following the decline of the pandemic-driven e-commerce surge, marking a broader industry shakeout among similar aggregators.
Scheduled for September 17 in Berlin, the auction comes after negotiations between SellerX, its investors, and lenders did not reach a resolution, potentially wiping out existing equity investments. The downturn in online sales post-pandemic left many aggregators, including SellerX, struggling with unsustainable debt levels, highlighting the risks of rapid expansion based on speculative growth forecasts.
Temu Begins Enlisting U.S. Brands Amid Marketplace Growth
Temu, known for its vast marketplace predominantly featuring Chinese sellers, is making strides to recruit U.S. and European brands as it seeks to diversify its offerings and reduce reliance on the de minimus import loophole. This shift aims to improve product variety, shipping speeds, and overall competition with domestic products.
Despite Temu’s aggressive recruitment strategy, which promises lower fees and enhanced onsite placement for new sellers, the platform faces challenges in attracting established U.S. brands, mirroring the struggles of similar marketplaces like Wish and Shein. Temu’s growth and its attempt to reposition itself as more than just a hub for inexpensive imports involve a long-term strategy to appeal to domestic sellers and broaden its market appeal.
Challenges for eBay Sellers Facing Low-Ball Offers
eBay sellers who reject low-ball offers might face unexpected challenges beyond simple negotiation rejections. One seller shared a story on YouTube about a buyer who, after having a low offer rejected, purchased the item at full price only to leave neutral feedback complaining about poor communication.
This incident highlights a potential issue where buyers retaliate against sellers for not accepting low offers, complicating the seller’s ability to maintain a positive reputation. eBay’s current policies may not fully protect sellers from such retaliatory feedback, raising concerns among the seller community about the need for more robust support from the platform in these situations.

Decoding Amazon’s New “Views” Metric: A Closer Look at SERP for Sellers
Amazon’s introduction of the “Views” metric in its search engine results page (SERP) is stirring interest among sellers due to its implications on perceived product performance. Luba Ilyasova’s analysis reveals discrepancies between Amazon’s displayed views and purchases and the actual data, showing the “Views” metric can sometimes give a misleading impression of a product’s conversion rate and success.
For instance, while the displayed data for one of Ilyasova’s products suggests a 30% conversion rate, the actual figures calculated from sessions and sales present a significantly lower rate. This discrepancy suggests that while the metric can help gauge interest, sellers should be cautious, as it may not fully align with actual sales performance, potentially affecting strategic decisions.
